Terms of Service

Welcome to Recipe Gnome (“the Service”). By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

1. Use of the Service & User Conduct

You must be at least 13 years old to use Recipe Gnome. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

To keep the Service running smoothly for everyone, you agree not to:

  • Use the Service for any unlawful purpose.
  • Introduce viruses, malware, or any other malicious code.
  • Use automated scripts, spiders, robots, or scrapers to access, copy, or extract any content or recipes from the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

2. Subscriptions, Payments, and Auto-Renewal

Certain features of the Service require a paid subscription. All fees are stated in US dollars and are non-refundable except as required by applicable law. We reserve the right to change pricing at any time, but will provide you with reasonable advance notice of any price increases.

Auto-Renewal: If you sign up for a paid subscription, your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings.

3. Your Content and Our License

You retain full ownership of any recipes, notes, and other content you submit to the Service (“Your Content”).

A. License to Recipe Gnome: To operate the Service, you grant Recipe Gnome a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display Your Content. This allows us to host your data, back it up, and format it for different devices. Additionally, you grant us the right to use publicly shared portions of Your Content (such as recipe titles, images, and ingredients) for marketing and promotional purposes.

B. Sharing With Other Users: The Service may allow you to share Your Content with other users or make it public. By choosing to share Your Content, you grant Recipe Gnome the right to distribute and display it to those users. Furthermore, you grant those users a non-exclusive license to access, view, and use Your Content as permitted by the functionality of the Service.

C. Privacy and Control: You are responsible for what you choose to share. We will only share Your Content with other users in accordance with the settings and features you select within the Service. We will not sell your personal data or private recipes to third-party data brokers.

4. Copyright Policy (DMCA)

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please send a notice to our designated Copyright Agent via the contact method in Section 13.

Your notice must include: a description of the copyrighted work, where the material is located on the Service, your contact information, a statement of good faith belief that the use is not authorized, and a statement made under penalty of perjury that the information is accurate and you are the copyright owner.

5. Termination & Data Retention

We reserve the right to suspend or terminate your account at any time for conduct that we determine, in our sole discretion, violates these Terms or harms the Service. You may cancel your account at any time.

Upon termination or cancellation of your account, we have no obligation to maintain or provide you with a copy of Your Content. We strongly recommend that you export or back up your recipes prior to canceling your account.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information obtained through the Service is accurate or reliable.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RECIPE GNOME AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR LOST DATA) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless Recipe Gnome, its affiliates, and its operators from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, Your Content, or your violation of these Terms.

9. Dispute Resolution: Arbitration & Class Action Waiver

Please read this section carefully, as it affects your legal rights.

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You and Recipe Gnome agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Governing Law and Venue

These Terms and any disputes arising out of them shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles. For any disputes not subject to arbitration, you and Recipe Gnome agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice within the Service before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
